We call on and urge citizens to oppose Michigan HR 4326 and its companion Senate Bill that would prohibit application of state water and environmental standards more strict than federal. Both the federal Clean Water Act and Clean Air Act state that federal standards do not preempt more stringent state standards. The states, including Michigan, have applied independent and often more protective standards for over 30 years. HR 4326 and its companion Senate Bill constitute an abandonment and waiver of state power and rights in favor of federal power and rights, ironically and sadly odd coming from conservatives and Republicans who have always championed the rights and power of the states and their citizens. This is disastrous on so many fronts, including protection of our water, wetlands, and control of coal fired power plants, fracking shale for natural gas with all of its risks and massive water use.
